New REACH Restriction of CMR Substances in Textile Articles and Clothing

The EU Commission published a draft regulation in Feb 2018 that will amend REACH Annex XVII restricted substances list and restrict certain substances classified as carcinogenic, mutagenic or toxic for reproduction category 1A or 1B (CMR substance) in apparel, footwear and other textile consumer products. In this article, we will take a closer look at the restriction scope, the list of restricted CMR substances and proposed limits.

Affected Textile Articles and Clothing

The proposed restriction will affect the following products for consumer use:

  • (a) clothing or related accessories,
  • (b) textiles other than clothing which, under normal or reasonably foreseeable conditions of use, come into contact with human skin to an extent similar to clothing, [excluding disposable textiles]
  • (c) footwear

The proposed restriction does not apply to:

a) clothing, related accessories or footwear, or parts of clothing, related accessories or footwear, made exclusively of natural leather, fur or hide;

b) non-textile fasteners and non-textile decorative attachments;

c) second-hand clothing, related accessories, textiles other than clothing or footwear. 

In addition, the restriction does not apply to personal protection equipment (PPE) defined in  Regulation (EU) 2016/425 and medical device defined in Regulation (EU) 2017/745.
